I have seen so much b.s. in that place and I was in on burglary. Montana needs to get with it and figure the legal system out so people quit being screwed so the state can keep getting money. How much MORE evidence does the state need then to hear from eye witnesses??? Barry Beach and his legal team have gone above and beyond every blow from the State to prove his innocence. The State on the other hand has done very little to none in the way of proving his guilt. They are strictly going off of a forced, coerced confession. The interrogation tape which was evidence was missing at the time of his trial and so therefore was “rewritten” by the interrogator who was fed information from MT law officials. “Beach’s confession provided details that law enforcement had not shared with the general public and which only the killer would have known.” In Barry’s confession his social security number is wrong, and mind you he was in the service and most certainly would have known his own social security number. In his confession I believe it states the murder took place in Wolf Point, however the murder took place in Poplar. In his confession he stated that Kim Nees exited the truck via the drivers door, however all evidence shows that Kim was dragged out of the passenger door. In the confession Barry described her clothing, however that was wrong as well. In the confession Mr. Fox I believe Barry stated that he choked Kim, however the autopsy report showed no signs of strangulation. The only thing the State of Montana has is a confession that has more loop holes than facts!!! What they DO have however, is physical evidence that they continue to ignore and REFUSE to test. WHO DOES THE BLOODY PALM PRINT BELONG TO MR FOX???? Why do you continue to ignore having DNA testing done on the physical evidence such as the bloody towel, the beer cans, the cigarette butts??? The palm print does not belong to Barry Beach or to Kim Nees. Montana refuses to find out who it DOES belong to ! Why was Mr. Greyhawk never prosecuted for breaking in to the evidence room and tampering with evidence?? Certainly as a police officer he KNEW where the bathroom was – and besides if he had to go so bad, his male anatomy certainly provided him the tool to relieve himself on a tree or a tire outside for crying out loud. The three member Clemency Panel? One of them nodded off on National television!!! Mr. Fox you make a statement stating that this made Montana “proud” ??? NO Montana is NOT proud – your office is. The elected officials past and present are proud, but rest assured that members of the Kim Nees family are NOT proud. Kim Nees is NOT proud!!!

It was my understanding that the hearing in which Judge Phillips granted Barry a new trial was to provide and prove NEW evidence of innocence. The new evidence clearly showed that had this evidence been provided at the original hearing the jury may not have found Barry Beach guilty to begin with. The State can’t have their cake and eat it too. NOW they wanted to include OLD evidence??? Then let’s test that bloody palm print!!! If they want OLD evidence then let’s do DNA testing! God Bless Judge Phillips for being an HONEST person and doing the right thing. Some elected officials could learn from him!

Not once but twice Barry has been notified with an incredible lack of professionalism. First the BOPP sends their decision via email. Tuesday Barry receives decision from the Supreme Court via media? In most states you are innocent until proven guilty….in Montana you are guilty until proven innocent! Shame on you Montana~! Montana residents remember this is your hard earned money working for you!!! It costs taxpayers a LOT of money to incarcerate an innocent man! Remember that when it comes election time!!
